Legionnaires' Outbreak in New York: The Cooling-Tower Lesson for UK Duty-Holders
A Legionnaires' disease outbreak on Manhattan's Upper East Side, traced to cooling towers across dozens of buildings, has left five dead. Here is what it means for UK water hygiene companies and duty-holders under HSG274 Part 1 and ACoP L8.
A Legionnaires' disease outbreak on Manhattan's Upper East Side has been traced to cooling towers. As of 22 July, 82 cases had been identified and five people had died; eight remained in hospital and 56 had been discharged. New York City's health department said confirmatory culture testing found live Legionella bacteria in 34 cooling towers across 33 buildings in the affected area.
New York knows this pattern. Its largest modern outbreak, in the South Bronx in 2015, was also traced to contaminated cooling towers and prompted the first city-wide cooling-tower registration and inspection law in the United States.
For UK water hygiene and treatment companies, an outbreak on another continent is not just news. It is a prompt to look at the part of the Legionella risk that most routine assessment work touches least: cooling towers and evaporative condensers.
Why cooling towers cause the big outbreaks
Most of the Legionella risk assessment work carried out in the UK is domestic hot and cold water services - the world of HSG274 Part 2. That work matters, but building water systems tend to produce building-scale problems: an exposed individual, a single premises.
Cooling towers are different. They:
- Disperse aerosol over a wide area. A single contaminated tower on a roof can seed Legionella across streets and neighbouring buildings, which is why cooling-tower outbreaks are so often community outbreaks with dozens of cases rather than one or two.
- Run warm and wet by design. They sit in the ideal growth range for much of the year and provide exactly the aerosol-generating conditions Legionella needs to reach the lungs.
- Get forgotten. Towers that run seasonally, or that were left in place after a plant change, are the classic source - out of sight on a roof, off the monitoring schedule, quietly colonising.
That combination is why the New York clusters, like the 2015 Bronx outbreak before them, keep coming back to cooling towers.
The UK position: this is Part 1, and it is regulated separately
In the UK, cooling towers and evaporative condensers carry their own regime on top of the general duty under the ACoP L8 approved code:
- They must be notified. Under the Notification of Cooling Towers and Evaporative Condensers Regulations 1992, every wet cooling tower and evaporative condenser must be registered with the local authority. An unregistered tower is both a legal failure and, usually, a monitoring failure.
- They sit under HSG274 Part 1. Part 1 sets the control regime - treatment, biocide dosing, monitoring, cleaning and disinfection frequencies - that is distinct from the hot and cold water guidance most assessors use day to day.
- They demand live control, not just a document. Dip slides, dosing records, drift eliminator condition and the cleaning schedule are the things that actually prevent an outbreak. The risk assessment is the start, not the finish.
What it means for your contracts
If you deliver Legionella services to estates with wet cooling systems, the New York outbreaks are a good reason to check three things across your client base:
- Is every tower on the register - and is the register current? Decommissioned plant that still holds water, and towers added during a refurb, are the ones that slip.
- Are seasonal and standby towers being managed year-round? A tower that only runs in summer still needs a controlled shutdown, lay-up and pre-start regime. Stagnant water in a "switched-off" tower is a textbook source.
- When did the control regime last get independent eyes on it? Part 1 monitoring is easy to run on autopilot until a sample comes back positive. A second-line review catches drift before the health authority does.
Sampling has a particular role here. Routine microbiological sampling and UKAS-accredited lab analysis of cooling-tower water is how you convert a control regime from "we think it's fine" into evidence you can put in front of a duty-holder, an insurer or - if it ever comes to it - an investigator.
The takeaway
Community Legionnaires' outbreaks are, overwhelmingly, cooling-tower outbreaks. The UK's notification regime and HSG274 Part 1 exist precisely because of events like the ones New York keeps reporting. The organisations that stay out of the headlines are the ones that treat the tower register as a living document, manage seasonal plant properly, and get an independent review before a positive sample forces one.
